General Terms of Service

{Payment}
We accept Credit Card Payments and e-Checks through Paypal. When paying with e-Check, please note that no work will begin on your design project until the e-Check has cleared through Paypal.

{Shipping}
Shipping and Handling for all of our Graphic and Web Design work is Free, as all products are delivered digitally. If you require a copy of your project or design on CD, please contact us for pricing. Items requiring shipping, such as logo cds, graphic cds, or our new printing services will incur shipping fees based on the number of units ordered.

{Template Installation}
Once you approve the proof of your custom or pre-made template, we will request your log in credentials for the installation process. Templates will be installed within 24 business hours or receiving valid log in credentials requested and approval of the customized proof.

Please note that we must receive your log in credentials within 21 business days from receiving your approval of the proof, as we can not hold orders open indefinitely. If you exceed this time table, your customized files formatted for your approved host will be emailed to you via email and you will be responsible for installing your files into the approved software or you can pay a $10 installation fee for us to upload the files for you when you are ready to have them installed.

For accounting and organization purposes we will be enforcing this policy more strictly in the future.

{Graphics}
Graphics and our finished page layouts are not to be resold, re-formatted, re-used, transferred, reposted, given away, changed, revised, decompiled in whole or in part for any reason by the client who purchased or any other party on their behalf. You are purchasing either a non exclusive use license(for Unlimited Designs or Limited Ed. Designs) or an Exclusive Use License(for OOAK and Custom Designs). You may only use the purchased templates in the manner stated within the listing for your own website and the domain for which it was purchased and licensed. Please note that licenses can not be transferred either internally or to an outside party by the purchaser or any other party on their behalf. If you need to use the template on a new domain, you will need to re-purchase(if quantities are available), as the purchase will include a new license for the new domain. The copyright and all other rights for the template design, graphics, layout, and coding remains with Mod Melon. Mod Melon does not release source or layered graphics with any of our templates or designs. You will receive the graphics in your purchased design customized with your details, but they will be in a merged web format(.gif or .jpg) and they may only be used in the manner for which they were intended.

Please Note:
We will not use graphics created or utilized by other designers, due to the fact that we can not verify copyright and origin of the graphics. We will require that any design we create use either our own hand/mouse drawn illustrations/graphics or graphics we have obtained from one of our verified resources. This policy was created to insure that any design we deliver to our clients is 100% legal and compliant. The only exception to this is if you have a logo design to which you own the copyright. If this is the case, we will need to see a written statement to this effect from the logo designer before we will make the final determination of whether the logo can be used in our design.

{Copyrights:}

If you need a matching design created for another use, please contact us for a quote as we normally offer discounts to our current or previous design customers.

The graphic images we use in our templates and designs have been created by Mod Melon or it's licensors. We take copyright infringement seriously, and any one caught abusing our policies will be required to correct the issue immediately. If we do not receive compliance from the offending party, the hosting company of the offender will be notified of the infraction. All credit links at the bottom of the design must remain in place for legal use of the design. The credit will be in the form of a link at the bottom of the design. All copyrights should be respected and upheld.

We dislike having to put a statement like this on our website, but we also have to protect our intellectual property rights and the rights of our customers. Due to some recent events of copying, we feel the need to place this statement on this page as a reminder of Basic Copyright and Intellectual Property Rights laws. The designs on our website are copyright protected and any copying of design concepts, layout, coding, or graphics is not only unethical, but it is also illegal.

****Note to Web Designers****
I am adding some specific terms for other web designers to follow:

Our graphics/website templates can NOT be used to design websites for your clients or to design website or auction templates that you will then sell and gain profit from. You may not purchase our design, add it to a site, then re-sell it and gain profit directly from our design being used. We retain all rights to our images, coding, concepts, and layouts. When you purchase a design from us, you are only purchasing a license to use the items in the manner stated in the listing AND if all terms are met. You do not, under any circumstance have re-sell rights to the graphics, coding, layout, or concepts.

I urge clients to inspect your designer and their background to ensure they comply with copyright laws, as you can be held responsible for using illegal coding and graphics.

PROOFING
Pre-made designs do not come with multiple revisions to a proof we send you, a proof for made to match items and pre-made templates is provided to insure accuracy of the customizations only-additional proofs are not included in your pre-made/made to match pricing.

All quotes for semi-custom/custom graphic or other design work, will have a maximum of three rounds of revisions included in the price we quote to you. You will receive a first draft proof and up to 2 additional revisions. If additional revisions outside of this are required, you will be billed at the rate of $10 per revision per item.

{Portfolio}
Mod Melon reserves the right to use your completed design and any additional graphics created for your design in our Portfolio as a representation of our past work experience.

It is the clients responsibility to make sure they have read, understand, and comply with our terms of service before completing their purchase.

We reserve the right to refuse service to any company or indivual at our discretion.
